The undersigned person is granted limited permission by Cordelia Winery LLC, a California limited liability company d/b/a Caymus-Suisun Winery (“Owner”) (1) to enter Owner’s property commonly known as Caymus-Suisun Winery located at 4991 Suisun Valley Road in Fairfield, California (“Premises”) for the purpose of attending a special event and engaging in certain games and activities in connection with said event ("Permissive Entry").

In consideration of Permissive Entry to the Premises, I for myself and my personal representatives, heirs, next of kin, spouse, estate, assigns and all other persons and entities that in any way could represent me, in consideration for allowing the undersigned to participate any such activities DO HEREBY EXPRESSLY AND VOLUNTARILY:

1. AGREE TO FOREVER RELEASE, ACQUIT, DEFEND AND INDEMNIFY, DISCHARGE AND COVENANT NOT TO SUE the Owner, its affiliates, members, and owners and each of them, their officers, agents, heirs, successors, assigns and employees (all hereinafter collectively referred to as “Releasees”) and do hereby release acquit, defend, indemnify and hold harmless all such Releasees from any and all claims, actions, suits, damages, debts, judgments, costs, attorneys’ fees, demands, in law or equity, and any liability arising out of strict liability or ordinary negligence of Releasees or any other participant which causes the undersigned injury, death, property damage or any other damages whatsoever. I further do hereby covenant to hold Releasees harmless and indemnify Releasees from and against any claim, judgment or expense Releasees may incur arising out of my activities or presence on the Premises. This waiver is intended to be a complete release of all responsibility or duties owed by Owner or Releasees to the undersigned for personal injuries, death and/or property loss/damage sustained by undersigned while on the Premises.

2. ACKNOWLEDGE THAT I ASSUME ALL RISK for myself and assume all liability to others for any such failure to act in a manner to not cause harm to others, and I hereby RELEASE Releasees for any failure on my behalf. I am not an agent, servant or employee of Releasees and no oral representations or inducements have been made to me to sign this agreement. If any portion of this agreement is held invalid, it is agreed that the balance thereof shall continue in full legal force and effect.

3. UNDERSTAND AND AGREE that this agreement shall apply to any incident, injury, accident or death occurring at the Premises on the above date, and to any incident, injury, accident or death occurring thereafter at the Premises and further that this agreement is (a) clear, unambiguous and unequivocal; (b) explicit and voluntary in my waiver, release an assumption of risk; and (c) comprehensive for all lawsuits, claims, injuries and damages.

I HAVE READ THIS DOCUMENT. I UNDERSTAND THAT IT IS A RELEASE OF ALL CLAIMS. I UNDERSTAND THAT I ASSUME ANY AND ALL RISKS INHERENT WITH THE ABOVE-MENTIONED ACTIVITIES. I KNOWINGLY AND VOLUNTARILY SIGN MY NAME EVIDENCING MY ACCEPTANCE OF THE ABOVE PROVISIONS ON MY OWN BEHALF.
